Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using DeepGrooves ("the Service"), including the web application, desktop application, mobile application, and any associated websites or tools, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Prickly Cactus Software / DeepGrooves ("we," "us," or "our").

2. Description of Service

DeepGrooves is a personal vinyl and music collection management application that allows users to:

• Catalog and organize vinyl records, CDs, and other music media
• Search and import album metadata from third-party databases
• Rate and categorize albums in a personal collection
• Listen to short audio previews of tracks
• Access deep links to external music services
• Manage wishlists, folders, and custom categories
• Record plays, track listening history, and create Now Spinning images
• Create read-only share links and generated share images for selected portions of a collection

The Service is provided through the DeepGrooves web application, desktop (Windows), and mobile (Android) platforms, with data synchronized through a cloud backend.

3. User Accounts

3.1 Registration

To use certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. You may delete your account at any time by contacting us at support@pricklycactussoftware.com.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You shall not:

• Use the Service to infringe on any intellectual property rights
• Attempt to reverse engineer, decompile, or disassemble the Service
• Distribute, sublicense, or resell the Service without written permission
• Use the Service to transmit harmful, offensive, or illegal content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools to scrape, crawl, or extract data from the Service beyond normal usage
• Circumvent any technical limitations or access controls in the Service
• Interfere with or disrupt the integrity or performance of the Service
• Use share links, generated images, or email-sharing features to harass others, expose private information without permission, or distribute unlawful or infringing content

5. Intellectual Property

5.1 Our Property

The Service, including its design, code, logos, and documentation, is the intellectual property of Prickly Cactus Software / DeepGrooves and is protected by copyright and other intellectual property laws. All rights not expressly granted herein are reserved.

5.2 Your Content

You retain ownership of any data you enter into the Service (e.g., personal notes, ratings, custom categories). By using the Service, you grant us a limited license to store, process, display, and generate share outputs from your content solely for the purpose of providing the Service to you.

5.3 User-Generated Metadata

Album metadata, artwork, and tracklist information imported from third-party services remain the property of their respective owners and are subject to their terms of use.

6. Third-Party Services

DeepGrooves integrates with the following third-party services. Your use of these integrations is subject to the respective third-party terms:

6.1 Spotify®

The Service provides deep links that open the Spotify application or website to search for music. Spotify is a registered trademark of Spotify AB. DeepGrooves is not affiliated with, endorsed by, or sponsored by Spotify. Full playback of content on Spotify may require a Spotify account and/or a paid subscription. DeepGrooves does not stream, cache, or redistribute any Spotify content.

6.2 Deezer®

The Service uses the Deezer API to retrieve short (approximately 30-second) audio previews of tracks for identification and sampling purposes. Deezer is a registered trademark of Deezer SA. DeepGrooves is not affiliated with, endorsed by, or sponsored by Deezer. Preview availability is determined by Deezer and may vary by region or licensing agreements.

6.3 Discogs®

The Service uses the Discogs API to search for and import album metadata, cover artwork, and tracklist information. Discogs is a registered trademark of Zink Media, Inc. DeepGrooves is not affiliated with, endorsed by, or sponsored by Discogs. Use of Discogs data is subject to the Discogs API Terms of Service.

6.4 MusicBrainz®

The Service may use the MusicBrainz database for music metadata lookups, including barcode-based searches. MusicBrainz is a project of the MetaBrainz Foundation. Data from MusicBrainz is available under the Creative Commons CC0 license. DeepGrooves is not affiliated with or endorsed by the MetaBrainz Foundation.

6.5 Supabase (Backend Infrastructure)

The Service uses Supabase as its cloud backend for data storage and authentication. Your collection data is transmitted to and stored on Supabase-hosted servers. Supabase's infrastructure is subject to Supabase's own terms and privacy policies.

6.6 Square (Payments)

The Service may use Square for checkout, subscription billing, customer records, and payment management. Payment transactions are subject to Square's own terms and privacy policies. We do not store full credit card numbers.

6.7 Resend (Email Delivery)

The Service may use Resend or a similar email provider to send transactional emails, account notifications, and requested share emails. You are responsible for entering recipient addresses accurately and for sending share emails only to people you are permitted to contact.

6.8 Social Platforms

The Service may help you prepare a caption, copy an image, download an image, open a social sharing page, or use your device's native share sheet. DeepGrooves does not post automatically to Facebook, Instagram, X, Bluesky, or any other social platform. Your use of those platforms is governed by their own terms, privacy policies, audience controls, and posting rules.

6.9 General Third-Party Disclaimer

All third-party trademarks, service marks, logos, and trade names referenced herein are the property of their respective owners. Their inclusion does not imply any affiliation with or endorsement by the trademark holders. We are not responsible for the availability, accuracy, or content of any third-party service. Third-party services may change their APIs, terms, or availability at any time without notice.

7. Audio Previews

The Service provides short audio previews (typically 30 seconds) sourced from the Deezer API for the purpose of track identification and sampling. These previews are:

• Streamed in real time and not stored locally on your device
• Provided by Deezer under their API terms
• Subject to availability and regional restrictions
• Intended for personal, non-commercial use only

The Service does not enable downloading, recording, or redistribution of audio content.

8. Fees and Payments

DeepGrooves may offer free, beta, paid, founder, and promotional plans. Current prices, included features, and billing periods are shown at checkout or on the DeepGrooves pricing page.

Founder pricing is available to eligible users who sign up during the founder pricing availability period, currently through December 31, 2026. If you claim founder pricing during that period, the founder price will remain locked for your account as long as the subscription remains active and in good standing. Taxes, payment provider fees, failed payments, cancellations, account abuse, or future plan changes may affect eligibility or continued access.

Payments are processed by third-party payment providers. We do not store full card numbers. Subscription access may continue until the end of the paid billing period after cancellation unless otherwise stated at checkout.

You agree to indemnify, defend, and hold harmless Prickly Cactus Software / DeepGrooves and its developers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Continued use of the Service after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Prickly Cactus Software operates, without regard to its conflict of law provisions.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Prickly Cactus Software / DeepGrooves regarding your use of the Service and supersede any prior agreements.
